Right to Safety - Customer Rights |
To give more rights to the rights, the three-decade-old law is being changed. In the Lok Sabha, Consumer Protection Bill 2018 has passed and it will now be sent to the Rajya Sabha. The new law will replace the Consumer Protection Act of 1986. It can be revolutionary about consumer rights in the country. Under this, consumers and agencies have been given more rights than the existing law.
1. The bill proposes to constitute the Central Consumer Protection Authority. The agency can intervene to protect the rights of consumers and to prevent unethical business activities. Apart from the order to withdraw the product or refund, 'class action' can be taken against the company. This agency will be highly effective in the entry of the US Federal Trade Commission.
2. A new concept of 'class action' has been added to the bill, which means that the responsibility of the manufacturers or service providers will not be restricted to only one or a group of consumers, but rather to all customers. Under Class Actions, all affected consumers will be beneficiary.
3. In the event of the death, injury or other loss of the client due to weakness in the manufacturing, construction, design, formula, construction, assembly, testing, service, instruction, marketing, packaging, labeling etc of a product, the manufacturer, producer and here Even the vendors have been arranged to make them responsible.
4. To resolve consumer disputes in the bill, it is proposed to remove the structures present at the district, state and national levels. This will make consumers more powerful The new bill provides that if the District and State Consumer Forum declares the judgment in the interest of the consumer then the accused company cannot go to the National Forum.
5. At all levels, the consumer mediation cell will be linked to the Consumer Commission so that the Commission does not burden the burden of excessive cases.
6. There is much more in this law about e-commerce. At present, a customer can take legal action against the seller in the same place where the transaction happened. In the new law, the consumer can file an online complaint or visit the consumer court near his place of residence. The new law is important for early settlement of cases. Consumer video conferencing can also participate in the hearing.
Consent for data access to consumers has been compulsory for e-commerce companies. E-commerce companies also have to disclose business details and cellar agreements. They must also tell how consumer data is used in the form.
7. In addition to the bills in the bill, people promoting the product are also held responsible. There is a provision for a fine of 2 years and a penalty of up to Rs 10 lakh on wrong or misleading advertisements causing harm to the customers. In severe cases, a penalty of up to 10 years and up to Rs 50 lakh can be imposed. Frauds on fraudulent advertisements will be imposed, though they will not be jailed.
8. There is also provision for composite supply or bundle services in the bill. For example, if a platform is offering travel services with hotel tickets and airline tickets, then it will be held responsible for all services.
9. In order to prevent false complaints, the provision of penalties ranging from Rs. 10,000 to 50 thousand rupees has been kept in the bill.
